Terms of Use — eksc.co.uk

By accessing and using eksc.co.uk, you agree to these terms. eksc.co.uk is operated by EKSC LTD, a private limited company registered in England and Wales (Company No. 15834846).

The website serves as the corporate website for EKSC LTD and provides information about the group, its brands, services, payment infrastructure and policies.

Contracting Entity for Transactions

Where EKSC LTD central checkout infrastructure is used for a transaction, EKSC LTD is the contracting and payment-processing entity for that transaction. The relevant brand is shown clearly to the customer at checkout, but the legal entity issuing the charge, processing the payment and fulfilling the associated support, refund and complaint obligations is EKSC LTD.

In the event of any conflict between brand-level terms and these group-level terms, the group-level terms govern where EKSC LTD is the contracting entity for the transaction.

Refunds & Returns

  • UK customers: right to return most items within 14 days of receipt under the Consumer Contracts Regulations 2013
  • EU customers: right to return most items within 14 days under the EU Consumer Rights Directive
  • Items must be returned in original condition unless defective or not as described
  • Refunds processed to the original payment method within 14 days of return receipt, or within statutory timeframes
  • Return shipping costs are the customer's responsibility unless the item is defective or not as described

To initiate a return, contact support@eksc.co.uk with your order number and reason. Nothing in this policy affects statutory consumer rights.

Shipping & Delivery

  • Handling time: one to three business days from order confirmation; up to six business days during high-volume periods
  • Shipping: tracked services appropriate to the destination market
  • Estimated delivery: shown at checkout for each brand and market
  • Tracking: provided to the customer upon dispatch
  • Customs delays: outside our direct control; we will assist in investigating where possible

Payment Terms

  • Payment is taken at the point of order confirmation. No payment charged until the customer confirms their order
  • All prices displayed in the applicable currency, including applicable taxes where required
  • Where EKSC LTD central checkout infrastructure is used, EKSC LTD is the payment-processing entity
  • Card statements may show EKSC LTD or the relevant brand name as the descriptor
  • All card handling performed by regulated, PCI DSS-compliant providers via tokenisation. EKSC LTD does not store raw card data

Service Delivery Terms

  • Engagements accepted subject to fit and availability
  • Scope, deliverables, timeline and pricing confirmed in writing before commencement
  • Invoices issued by EKSC LTD
  • Services are non-instant and delivered by prior agreement
  • Scoped deliverable engagements: pro-rata refund for undelivered agreed deliverables if EKSC LTD is unable to deliver
  • Monthly retainer engagements: cancellable with 14 days written notice. Fees for current period non-refundable unless EKSC LTD fails to deliver
  • EKSC LTD makes no guarantees about specific commercial outcomes from advisory services

Intellectual Property

All content on eksc.co.uk, including text, design, logos and structure, is the intellectual property of EKSC LTD unless stated otherwise. Reproduction or distribution without written permission is not permitted.

Limitation of Liability

To the extent permitted by applicable law, EKSC LTD's liability in connection with products purchased through active group brands is limited to the value of the specific order in question. This limitation does not affect statutory consumer rights or liability for death or personal injury caused by negligence.

Governing Law

These terms are governed by the laws of England and Wales, subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to mandatory consumer protection rights in the customer's country of residence. EU consumers may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
